Forms Which Are Not Completed Correctly
It is crucial that information referring to the individual granting the LPA, the attorneys and certificates relating to capacity are correct. The OPG may delay or reject incorrect applications.
Failure to Certify an LPA
All LPAs must be certified to confirm the donor has understood the form and is not being pressured to submit it. Failure to have an appropriate person to certify will result in the application being rejected.
Not Informing People When a ‘People to Notify’ Section Is Included
Third parties may be included in the form to raise any concerns. This is not necessary, but if the donor adds anyone to check the LPA, these people must be informed. If they are not, delays may ensue.
Submitting Without Payment or with Incorrect Fees
The fee of £92 is payable for LPAs which have been received at the Office of the Public Guardian as of 17 November 2025. Reduced fees are available for donors on low incomes. The LPA is returned if the fee is not paid.
Not Registering an LPA Before Use
LPAs must be registered at the OPG prior to attorneys using powers. It is not valid once signed.
